Terms of Service
Please read these terms carefully before using Sky-Alo.
1. Acceptance of Terms
By accessing or using the Sky-Alo platform at www.sky-alo.com (the "Platform"), including our mobile applications and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
These Terms constitute a legally binding agreement between you and Sky-Alo, Inc. ("Sky-Alo," "we," "us," or "our"). By creating an account, listing a property, making a booking, or otherwise using our services, you acknowledge that you have read, understood, and agree to comply with these Terms, along with our Privacy Policy.
2. User Accounts and Eligibility
To use certain features of the Platform, you must create an account. You must be at least 18 years of age and legally capable of entering into binding contracts in your jurisdiction.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
Sky-Alo reserves the right to suspend or terminate accounts that contain false or misleading information, violate these Terms, or engage in fraudulent activity.
3. Property Listings (Host Responsibilities)
As a host, you are responsible for ensuring that your property listings are accurate, complete, and not misleading. Listings may be offered in one or more of three modes: vacation rental, monthly rental, or property sale.
You represent and warrant that you have the legal right to list your property, that it complies with all applicable local, state, and federal laws (including zoning, permitting, and tax regulations), and that it meets the safety and habitability standards described in our hosting guidelines.
Sky-Alo reserves the right to remove or de-list any property that violates these Terms, receives verified complaints, or fails to meet our quality standards. Hosts are solely responsible for obtaining any required licenses, permits, or insurance.
4. Booking and Payments (Guest Responsibilities)
Guests agree to pay all charges associated with their booking, including nightly or monthly rates, cleaning fees, service fees, and applicable taxes. All payments are processed through our third-party payment provider, Stripe.
By making a booking, you enter into a direct agreement with the host for the use of their property. Sky-Alo acts as an intermediary platform and is not a party to the rental or sale agreement between hosts and guests.
You agree to treat the property with care, comply with house rules set by the host, and vacate the property by the agreed-upon checkout time. Damage to the property may result in charges assessed through our resolution process.
5. Platform Fees and Commission
Sky-Alo charges a host commission of 3% on completed vacation and monthly rental transactions. This commission is deducted from the host's payout before disbursement.
Guests are charged a service fee calculated as a percentage of the booking subtotal. The exact service fee percentage is displayed before booking confirmation. Property sale transactions may be subject to separate fee structures as disclosed during the listing process.
All fees are non-refundable unless otherwise stated. Sky-Alo reserves the right to modify fee structures with 30 days' advance notice to affected users.
6. Cancellation Policies
Sky-Alo offers a 7-tier cancellation policy system for vacation rentals, ranging from Flexible to Super Strict. Hosts select the applicable cancellation policy for their listing, and the policy is clearly displayed to guests before booking.
The seven tiers are: Flexible, Moderate, Moderate-Strict, Firm, Strict, Very Strict, and Super Strict. Each tier defines specific refund percentages and cutoff deadlines relative to the check-in date. Full details of each tier are available on the listing page and in our Help Center.
Monthly rental and property sale cancellation terms may differ and are governed by the specific agreement between the host and guest or buyer. Extenuating circumstances (natural disasters, government restrictions, serious illness) may qualify for exceptions under our Extenuating Circumstances Policy.
7. Prohibited Conduct
You agree not to:
- Provide false, misleading, or fraudulent information in listings, profiles, or communications
- Circumvent the Platform to arrange bookings or payments outside of Sky-Alo
- Discriminate against guests or hosts based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected characteristic
- Use the Platform for any unlawful purpose, including subletting in violation of lease terms or local regulations
- Harass, threaten, or abuse other users of the Platform
- Attempt to reverse-engineer, scrape, or interfere with the Platform's technical infrastructure
- Create multiple accounts for fraudulent purposes or to evade enforcement actions
Violation of these prohibitions may result in account suspension, termination, and/or legal action.
8. Intellectual Property
All content, features, and functionality of the Platform -- including but not limited to text, graphics, logos, icons, images, software, and the Sky-Alo name and trademarks -- are the exclusive property of Sky-Alo, Inc. or its licensors and are protected by intellectual property laws.
By posting content on the Platform (including listing photos, descriptions, and reviews), you grant Sky-Alo a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with operating and promoting the Platform.
You retain ownership of content you create but may not use Sky-Alo's proprietary content, branding, or data without prior written consent.
9. Third-Party Data Sources and Services
The Platform integrates with third-party services to provide market intelligence, mapping, and payment functionality. By using the Platform, you acknowledge and agree to the following:
- RentCast -- provides rent estimates, property valuations, sale market data, and historical trends. Data is informational only and does not constitute an appraisal or guaranteed valuation.
- AirROI -- provides vacation rental market data including average daily rates (ADR), occupancy rates, RevPAR, and revenue projections. Actual performance may vary from estimates.
- Google Places / Google Maps -- provides address autocomplete, geocoding, and embedded map views. Use is subject to the Google Maps Platform Terms of Service.
- OpenStreetMap + Leaflet -- provides interactive map tiles for property search. Map data is contributed by OpenStreetMap contributors under the Open Database License.
- Stripe -- processes all payments, payouts, and financial transactions. Stripe is a PCI-DSS Level 1 certified payment processor. Sky-Alo does not store credit card numbers on its servers.
Sky-Alo does not guarantee the accuracy, completeness, or timeliness of data provided by third-party sources. Market data, valuations, and projections are estimates and should not be relied upon as financial, legal, or investment advice.
10. Limitation of Liability
To the maximum extent permitted by law, Sky-Alo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of profits, data, or business opportunities.
Sky-Alo's total aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to Sky-Alo in the twelve (12) months preceding the claim or (b) one hundred U.S. dollars ($100).
Sky-Alo does not guarantee the quality, safety, or legality of listed properties, the truth or accuracy of listings, or the ability of hosts or guests to fulfill their obligations. Users interact with one another at their own risk.
11. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Platform shall first be addressed through our internal resolution process. If a resolution cannot be reached, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
You agree that any arbitration shall be conducted on an individual basis and not as a class action or collective proceeding. The arbitration shall take place in the state of Delaware or remotely, at your election.
Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
12. Modifications to Terms
Sky-Alo reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and, where practicable, by sending an email notification to the address associated with your account.
Changes become effective upon posting unless otherwise specified. Your continued use of the Platform after any modification constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform.
